If you have suffered an injury or illness as a result of medical negligence, you can make a claim for compensation. This compensation will cover for the pain, loss of amenity and any financial losses incurred due to the injury.

When medical negligence happens, many claimants understandably want to have an estimated value in mind before they decide to pursue a claim. However, while Medical Negligence claim calculator may help to some extent, you must note that it is impossible to predict the exact compensation award you will receive for your claim. This is because each medical negligence case is unique, and the value of a claim will depend on the individual circumstances of the claimant prior to the negligent treatment and how the negligent treatment has impacted his or her life.

Medical Negligence Solicitors at Medical Negligence Direct will spend time assessing your case to quantify your claim. Before then, however, let us discuss some of the damages you can claim, and how much you can possibly expect.
GENERAL DAMAGES

This is a term that describes compensation awarded for the pain, suffering and loss of amenity incurred by a medical negligence victim. The compensation awarded for general damages varies greatly from case to case, depending on the nature, severity and duration of the injury.

See the table below for a general overview of the guidelines:

Pain, suffering and loss of amenity (PSLA) refers to the impact an illness or injury has had on your life. The guidelines published by the Judicial College will help your solicitor when estimating how much you could claim.

See the table below for a general overview of the guidelines:

SPECIAL DAMAGES

This is a term that describes compensation awarded for any financial losses incurred as a result of the injury you suffered. This compensation will include lost earnings, medical bills and any other expenses you’ve had to undertake due to the negligent treatment.

WILL ANY AMOUNT BE ADDED TO MY COMPENSATION AWARD?

Yes. Once the general and special damages have been calculated, the final settlement may be adjusted as follows:

Judicial College Guidelines If you signed a No Win No Fee agreement with your solicitor after 2013, the final amount you will receive will be increased by 10%. This will help offset the impact of the success fee deducted by your solicitor.   Multiple Injuries Judicial College Guidelines/Negotiation with solicitor/Court verdict If you have suffered multiple injuries, the compensation you receive will be increased according to the nature and severity of the injury.   WILL ANY AMOUNT BE DEDUCTED FROM MY COMPENSATION AWARD?

Possibly. This will depend on the circumstances surrounding the negligent treatment, as well as the terms of the No Win No Fee agreement with your solicitor.
